I believe Malaysia has to decide whether to be a strict religious country or a magnanimous one!

I have to say this or forever I will hold my piece/peace. Now I must ask the government to also be fair and to cut off the hands of Muslim caught stealing. Muslims who committed adultery, if found guilty, must be stoned to death. They do this in Afghanistan don't they in places where Taliban rules. Hey if we are at it why not go the whole nine yards right in so far as implementing the Syariah law! But if you ask me for my personal opinion this girl should be given a reprieve, why not and especially on this Holy Month of Ramadan where we forgive, but then who will listen!!!

This is from my previous posting in reference to this poor Kartika Sari Dewi Shukarno who is set to become the first woman in the country to be caned under the syariah after she decided not to appeal against her sentence.
Okay she was caught drinking beer at a restaurant in Cherating, Pahang, well we all know that alcohol is being sold everywhere in the country including Kelantan, gambling is rife, and prostitution is an undeclared income for the local authority. So what is new?!
Go to Genting casino you will most definitely find Malay-Muslims gambling so on and so forth.
But this is what I am thinking. Bear with me. There is now a force within the government, with the syarah world included, to make the Malays not to like Umno and Barisan Nasional (BN). Supposed, just supposed, there is a force like this syariah people who may be a Pas or a Pakatasn supporter or sympathiser getting their directive or instruction from Nik Aziz or Brother Anwar Bin Ibrahim to "execute" their power, not to safe guard the country mind you, but to make the "victim" hates Umno and the BN government.
I am certain Kartika, if she is a voter, will not give her vote to the BN. She will tell her friends and her friends will tell theirs and so on, and so on!
If the syariah people is really doing their job to save the Malays from going to hell under the instruction of the government then I will say to the government not to be hypocritical. You the government close one eye when Vincent Tan is operating a gambling dens, Lim Goh Tong family making money out of people's misery. When the government knowingly take taxes from such activity, but please do not, for the sake of Allah, cane this poor woman because she drinks a bottle of beer. I will say this and I think many will agree, to each his or her owns!
If I want to go to hell on my own accord there is nothing anyone can do, let alone the syariah police.
Meanwhile I implore my great Prime Minister Najib Razak to use his discreation and power to tell whomever is in charge not to cane this poor girl, furthermore it is bad for business for Malaysia especially to the eyes of the world!

FYI, back in 1980+, I saw several Muslim men drank alcohol at Hyatt Kuantan but no arrest.

Pasquale, please flip through the pages of Malaysian Tatler Magazine for the past 15 years....and guess which Royal family is the greatest consumer of hard liquor in Malaysia. Why is it that JAKIM etc chose to have a blind eye to such glam parties held every week and yet take action on this model with single beer in hand...perhaps and maybe her very first tryout. Islam makes people behave strangely like making bad people look good.

the amazement comes about because it is probably the first case of its kind where a sentence has been passed.

isn't that true of most things in malaysia - selective prosecution?

If one can control drinking than beer is actually good. It helps to cool the body, relax the mind and other benefit. Beer is make from all natural products and drinking is an enjoyment.

By using the law to stop people from drinking will show that this group are weak mentally as without the law to stop them they will drink like hell?

People who drink are actually smarter, the German, the Japanese, France and British all drink. The smartest people can control their drink, the stupid one cannot.

Persatuan Peguam Syarie Malaysia (PGSM) kesal dengan kenyataan dua pemimpin politik wanita mengenai hukuman yang dikenakan terhadap peragawati sambilan, Kartika Sari Dewi Shukarno, kerana kesalahan meminum arak.
Timbalan Presiden PGSM Musa Awang menyifatkan kenyataan Menteri Pembangunan Wanita, Keluarga dan Masyarakat Datuk Seri Shahrizat Abdul Jalil, dan Ahli Parlimen Titiwangsa, Dr Lo' Lo' Mohd Ghazali, sebagai menghina keputusan Mahkamah Syariah.
"Sebarang ketidakpuasan hati dengan keputusan mahkamah hendaklah dibuat melalui tatacara dan prosedur yang telah ditetapkan oleh undang-undang, " katanya dalam satu kenyataan di sini hari ini.
"Walaupun niat baik kedua-dua tokoh ini adalah untuk memperjuangkan nasib wanita, tetapi mereka perlulah faham akan kaedah dan cara pelaksanaan hukuman sebat menurut Islam," katanya.
Musa berkata, menurut Enakmen Tatacara Jenayah Syariah 2002 Negeri Pahang, hukuman terhadap pesalah wanita tidak akan dilaksanakan sekiranya pesalah itu hamil, sebaliknya ia hendaklah dilaksanakan selepas dua bulan dia melahirkan anaknya.
Bagi pesalah perempuan, hukuman hendaklah dilaksanakan dalam keadaan duduk, manakala pesalah lelaki disebat dalam keadaan berdiri, dan sebatan hendaklah dijalankan dengan kekuatan sederhana iaitu tukang sebat tidak mengangkat tangan melebihi kepala supaya tidak melukakan kulit pesalah.
Musa berkata, PGSM berharap pelaksanaan undang-undang itu akan menjadi pengajaran kepada semua masyarakat terutama orang Islam.

For once, I agree with you barking magpie/pasquale. Let the sinner decide the question of hell and heaven. Why should the authorities be so concern whether one goes to hell or heaven and can the authorities really see to that no one muslim do any thing haram. I guess not. I agree with one of the anonymous writer in your coloumn who has quoted about members of one royal family who are so indulged in dfrinking in public and making mockery of the law, fighting etc. Can the authorities act independently on everyone irrespective of ones standing in the society against such 'crime'.
Stop being hypoctical. Touching on syariah laws, I think so far BN govt has acted against people on such crime. There was one remote incident in Kelantan during UMNO's rule where the drinker was caned. Now in Pahang under BN again,the same punishment but on a lady who god knows could have repented taking into consideration that the offence commited was some years ago.

Kartika Dewi yang kemungkinan menjadi wanita pertama dikenakan hukuman sebat dijatuhi maksimum enam sebatan dan denda RM5,000, atas kesalahan meminum arak di sebuah resort di Cherating, Pahang, jam 11.40 malam, 11 Julai 2007.
Dia yang pada mulanya meminta penangguhan pelaksanaan hukuman sehingga rayuannya didengar, kelmarin memutuskan untuk menarik balik rayuan itu dan sudah membayar RM5,000 serta mahu menghadapi hukuman sebat secepat mungkin.

Wanita yang juga ibu kepada dua anak berusia tujuh dan lima tahun serta isteri kepada warga Singapura berkata, beliau berterima kasih dengan keputusan yang dibuat hakim kerana menjadi pengajaran pada diri serta orang lain.
"Saya sanggup menghadapi hukuman itu kerana keluarga saya terutama bapa, Shukarno Abdul Mutalib, 60, sentiasa memberi semangat dan berdiri di belakang saya dalam menangani semua cabaran.
"Suami saya juga menghormati keputusan itu (kekalkan hukuman sebatan) dan hasil perbincangan bersama ahli keluarga, saya redha menghadapinya.
Sementara itu, Shukarno berkata, beliau menasihatkan anaknya supaya menjalani hukuman berkenaan sebagai pengajaran pada dirinya.
"Saya memilih untuk menerima keputusan itu mengikut undang-undang yang sudah ditetapkan. Jadi, saya nasihatkan kepada ibu bapa supaya menjaga anak-anak sebaik mungkin kerana mereka terlalu terdedah kepada dunia luar penuh cabaran.
"Walaupun ada di kalangan rakan mengatakan kesalahan anak saya itu kecil, tetapi saya tidak mengambil mudah kerana ia boleh merebak ke tahap serius jika tidak dibendung dari awal," katanya.

Alcohol is not being mass produced and commercially marketed as a health supplement. This is a known fact or else alcohol would have been the most sought items on the druggist's shelves. The actual fact is that alcohol is not proven to have any beneficial health promotion properties.

Therefore, to influence newcomers to take alcohol by revealing its unfounded health booster claims is similar to telling them to try cigarettes to calm their mind; or try illicit drugs such as cocaine for its medicinal values ie such as antitussive effect, bla, bla.

The Government collects cess, taxes or duties from the breweries and it is channeled to the Treasury, to pay the Shariah administrators to put food on the table.

What abt other forbidden sins like eating pork, gambling, dating, watching 3x movies...etc? What will the punishment be? More Muslims will attend the syariah court so as to confess their past sins. This will be a bad "ideology" in the Muslim world. "Oh Syariah Court, Pls punish me for I have Sins, Judge me for I repent".

Alcohol should be banned totally like opium. Opium now does have a death penalty. Some countries do banned smoking at public places like bus stop, hospitals, car parks, children playground, or even shopping centres or restauraunts. You will be fine for doing it. Perhaps Malaysia should have a banned for Muslims entering any entertainment outlets, bars, casinos.. etc. This would certainly improve the community and society as a whole and create budget for the goverment. Any Muslim entering such ban locations will need to pay a hefty fine and this will certainly creates revenue.

Just because of one fool the whole community is fooled. Alcohol was once halal but was made haram just because a fool commits slander during the time of the prophet. Opium was once legal but are now illegal because no leader would want a drunken community or society in a country that needs a good moral society for a country to develop. If any substance be it opium or alcohol, it should be banned totally so that society will understand that Islam is a way of life whereby "drunkenness" is not the Islamic way. Yet again alcohol is still halal in medical science and opium was once used for the sake of healing.
If opium does carry a death penalty, what about alcoholic drinks? I wonder...

If you drink, consider your influence on the following kinds of people:

since bar and alcohol were brought in by the Brits and then later generated real income on Tanah Melayu, what was done by the government and the people to curb the spreading of alcohol consumption among Muslims?

'Caning for repent', 'Caning to deter', 'Caning to educate', 'Caning to teach'.

Repent - 'Oh Syariah court please punish me for I have sins, Pls cane me for I repent.' How certain are we that an offender has fully repent? To an alcoholic if the caning is just a symbol, I believe that it defeats the purpose. Just look at drug addicts, to be caned but yet the offence is done over and over again. Moreover, in Islam that is such a thing as 'Sembahyang Taubat' or Repent prayer whereby an offender feel disgrace in the eyes of Allah and he/she will perform it and not do it again. If Kartika had performed such prayers, can any mortal questioned her repentance? Or if only the caning is done will society believe that she had repented.

Deter - Why should caning for deter be done to symbolise it? To deter starts from society. 'Sale of tobacco under 18 is prohibited'. Is there a sign mentioning that 'Sale of alcohol to Muslim is prohibited'? Deterance is an act of community and is not a punishment.

Educate - The consuming of alcohol is prohibited when someone commits slander during the time of the prophet. The offender had cause a public nuisance and as such it has to be banned. The man was punish to educate the offender and the whole community. Yet again how is caning of Kartika symbolises caning to educate? She has been a Muslim for the past 32 years and has been educated by the Islamic society around her. Is Kartika knowledge on Islam really shallow? Is the society around her to be blamed? During the prophet time, Islam is at his peak and an offender is punish for drinking alcohol to educate is valid as perhaps he is new to Islam.

Teach - To teach a Muslim by caning is harsh be it a symbolic caning. How much can we teach? A child can be cane by the parents so as to teach him/her the right and wrong. What about an adult? Should an adult Muslim be caned if he ignores the Friday prayers?

SHould this whipping be done in public? So as to get the message to Islamic community? By not whipping we are all aware that Kartika's sins has tarnish her family's name all over Asia and now the world. She has given the message to all. Should society disgraced her further? Is that an Islamic faith? Is that what we want to reflect about Islam?

Reason behind the caning decision:-
Pleaded guilty as advised by Syariah Court, Hired Lawyer so as to lighten the sentence of not being caned but in vain. Was advised to appeal again after the sentence was made by the judge but was ask to disappeared and was verbally promise that warrant of arrest will not be issued by the Syariah court once appeal made. Is there such a ruling? Should Kartika trust this system? Should she appeal again after the sentence was handed down by the judge and to disappear as advised by the Lawyer? Will the court play Kartika out? In 2005 2 Muslim men had been appealing there sentence thru the lawyer in Kuantan Syariah court till now. When will this flip flop law be fully implemented? Is a fine of RM5000 justified and in accordance to Islam teachings? A 3 years of jail term is for those who could not afford the RM5000 fine and is this justified in Islamic Law? I wonder if a true Muslim will disappeared from court...Sigh. Unislamic indeed.
